[font=Verdana] 2007年3月至2007年6月，被告人吴永胜、戴信恩以营利为目的，在温州金马大厦合股开设香港“6HC”投注点(总庄家)，接受他人投注，并雇佣被告人孙建银、翁逢春进行接单、接受、记账、收兑等工作，为其非法经营香港“6HC”彩票。经营期间，被告人吴永胜、戴信恩以1赔40的赔率、10%至12%的高额“贴水”，通过被告人孙建银先后发展了被告人高小乐、杨武等35人为下庄家，并多次做庄接受其投注。经核算校对，被告人吴永胜、戴信恩、孙建银、翁逢春非法经营6HC35期，累计接受投注额达6300万余元。[/font]& Z) U+ N) `2 X% T: w
[font=Verdana] 2007年5月至2007年6月，被告人高小乐以营利为目的，在永嘉县乌牛镇开设香港“6HC”中间投注点(下庄家)，接受下家乐丹、乐清燕、阿林、阿七等人的多次投注，并将投注金额转投至被告人吴永胜、戴信恩处，从中获取1%左右的“贴水”。经核实校对，被告人高小乐非法经营6HC10期，累计接受的投注额达165万余元。[/font]
& ~' Q @; v0 T[font=Verdana] 2007年3月至2007年6月，被告人杨武以营利为目的，在永嘉县乌牛镇开设香港“6HC”中间投注点(下庄家)，接受下家陈小国、小华等人的多次投注，并将投注金额转投至被告人吴永胜、戴信恩处，从中获取1%左右的“贴水”。期间，被告人杨武自己投注6HC17期，金额达34万元。经核实校对，被告人杨武非法经营6HC31期，累计接受投注额达86万余元。[/font]
% H$ e5 P# j5 d6 [! R9 l[font=Verdana] 法院还查明，2007年7月17日，被告人戴信恩在永嘉县乌牛镇皮服城以营利为目的，聚集被告人高小乐等人以麻将的形式进行聚众Dubo，被告人孙建银在场帮忙抽取头薪，后被民警当场查获，缴获赌资13.4万元。[/font]" ], G, t* s+ g$ d9 `
[font=Verdana] 法院另查明，2005年11月5日晚，被告人杨武因琐事与被害人叶爱平在一家酒店吃饭时发生口角，被告人杨武便纠集他人与叶爱平等人发生冲突，继而引起互殴。互殴中，被害人叶爱平被砍伤。经法医鉴定，叶爱平损伤程度为轻伤。2005年11月，被告人杨武赔偿叶爱平经济损失5万元。事后，被告人杨武先后主动到公安机关，如实供述伤害叶爱平的事实。[/font]
( i7 f0 V9 ?) h8 T' E7 S[font=Verdana] 法院审理认为，被告人吴永胜、戴信恩、孙建银、翁逢春、高小乐、杨武违反国家规定，非法经营6HC，情节特别严重，其行为均已构成非法经营罪；被告人戴信恩、孙建银还以营利为目的，聚众Dubo，其行为又已构成Dubo罪；被告人杨武还故意损害他人身体健康，造成一人轻伤的后果，其行为又已构成故意伤害罪。[/font] |
