中新广东网11月23日电 (郑俊娜 钟紫薇) 网上6HC非法Dubo机构追讨赌债不成，竟委托律师拿着“借条”上法院起诉，称要追还“借款”，东莞市第三人民法院展开取证后揭开了这一不法真相，让其追债的“愿望”落空的同时，还得吞下苦果，承担近五千元的受理费。

今年八月初，东莞市塘厦镇的蒋律师来到东莞市第三人民法院起诉，称其当事人叶某文借给朋友60万元用于生意资金周转，约定说2010年8月2日前偿还，还当面打了欠条，现期限已满，对方未按约定还款，现委托蒋律师代为追讨60万元的本金及利息。 / q& h, T# w* k4 b. X9 v+ j" D
蒋律师拿着欠条，心想着这案子案情简单、证据又充分，便向其当事人表示这官司应该十拿九稳。却没成想到，法院后来调取的一份证据让他的“如意算盘”彻底落空了。
. C% i& I8 ^! L4 U* l D8 }& I 法院调取证据揭开真相：借款原是赌债！
1 V5 A/ w5 J7 M0 n( K# V* c# u 东莞市第三人民法院在受理案件后，很快进行排期、送达应诉材料。一天，承办法官突然接到被告黄某华的来电，其在电话中声称叶某文是网上6HC的上线，正是他提供账号给其Dubo，让其因此输了40万元。后来叶某文便叫人殴打胁迫其写下欠条，确认向他借款60万元。事后，黄某华还向派出所报案，派出所也已立案。 6 P: x. h4 C" P! {3 k, F
法官闻讯后，发现此案可能另有隐情，便前往派出所调查案件情况，后发现原告叶某文确已在派出所的询问笔录中承认网上开设6HC及殴打被告黄某华，并让他写下巨额欠款的事实。 % X. [( e7 s* P3 r
律师知悉当庭拒绝代理，原告“偷鸡不成反蚀把米” 9 n8 {/ E% Z2 o+ L
法院开庭审理当天，蒋律师在阅读完法院从派出所调取的材料后神色大变，当庭表示拒绝代理此案，并声称接此案时并不知情。在主审法官释明若其拒绝代理，将视为当事人缺席，相应的法律后果由当事人本人承担后，蒋律师仍坚持拒绝代理。考虑到公安机关已经介入该案，并正在进行侦查，主审法官依照有关法律规定，裁定该案按撤诉处理。原告叶某文不但没能拿回“借款”，反倒还得承担案件受理费4900元。 : w$ X4 `2 u0 N4 b

本案主审法官、东莞市第三人民法院陈法官表示，本案中原告叶某文主动提供网上6HC账户给被告，并在被告赌输以后，威逼、强迫其写下欠条，并非出于被告的真实意思表示，而且是用于赌债等非法债务。法律规定：出借人明知借款人是为了进行非法活动而借款的，其借贷关系不受法律保护。原告企图通过借条这种合法形式来掩盖其追要赌债的非法目的，其因此形成的借贷关系是无效的，不受法律保护。 |
