2011年高考全国卷2语文的作文题目，就像几天前李娜夺得法网女单冠军一样给力，虽然题目的内容主要还是讲诚信，但因为涉及彩票行业，可谓一石激起千层浪。

% r' S. _, E _2 Y 高考题目涉及彩票合适不合适？

2009年7月1日实行的《彩票管理条例》规定，不得向未成年人销售彩票，违者将处2000元以上1万元以下的罚款。另外，《条例》中还有“不得向未成年人兑奖”的规定。2 s$ c2 b" O8 n" U, b
9 r2 P! O' L+ B. N g9 Q7 u9 p
未成年人在一般是指未满十八周岁的公民。达到法定成年年龄的公民,天朝《民法通则》规定：“18周岁以上的公民是成年人。”凡满18周岁的公民，不论其性别、精神健康状况如何，均视为成年人。

& J1 m: r7 E; z" O! Q; |( D 那么，每年参加高考的千军万马之中，又有多少是18岁以下，又有多少是成年人呢？依据规定，高考的应试者都应该属于被禁止购彩的人群，甚至是刚刚可以达到购彩的规定，试想让这些在原则上没有接触过彩票的人去讨论彩票，出题人一定是小人书看多了，或者说没有相关行业知识。虽然考题的主要还是在讨论诚信，但高考出题人的这样表现，恰恰应了那句“不专业最可怕”的广告词。

4 S/ B1 |2 M& u- F& E 《彩票管理条例》第三十九条第五细则规定：以赊销或者信用方式销售彩票的，由财政部门责令停业整顿；有违法所得的，没收违法所得，并处违法所得3倍的罚款；对直接负责的主管人员和其他直接责任人员，依法给予处分；构成犯罪的，依法追究刑事责任。7 j' B2 H6 r3 a9 ~
v) C$ d# @2 U 《彩票管理条例》第四十一条第五细则规定：以赊销或者信用方式销售彩票的。由民政部门、体育行政部门责令改正，处2000元以上1万元以下罚款；有违法所得的，没收违法所得。# z F3 G# C/ E

我们再来看题目原题，这个专卖店业主的行为究竟是算违法呢还是算诚信呢？一边是法规条例一边是诚信。诚信在词典里的解释：是一个道德范畴，是公民的第二个“身份证”，是日常行为的诚实和正式交流的信用的合称。而法规则是所有在不违背道德范畴下行为的刚性保障力。然而如果违反了法规条例，道德范畴也就触犯了社会规范的普遍约束力，即便再怎么高尚，也是人所共知的虚伪。- r8 ?8 Q) D; O" o

彩票行业急需立法保障' n- M2 a' J I
; T' X) R2 y* C3 `: f 由于我国彩票业走的是先发行、后立法的路子，目前正面临着法制空缺的境地。彩票发行二十多年来，相关法律法规仅仅依靠的是一个管理条例，它所具有的法律效能是无法和立法相比拟的。近些年来彩票立法的呼声越来越高，公众对彩票业纳入法制化轨道的关注从未停止。我国彩票业的发展时间并不长，加上立法的滞后，遏制了彩票业的持续长足快速增长的势头，致使 “私彩”“赌球”等非法Dubo行为屡禁不止，彩票业的立法十分紧迫。只有有了坚实的法律基础，才能让彩票行业更好更稳地发展，为社会做更大贡献。
